US H-1B cap selection is now weighted towards higher wage levels

Status: In effect

A Department of Homeland Security final rule, effective 27 February 2026, replaced purely random H-1B cap selection with a weighted process that generally favours higher-skilled and higher-paid positions, while keeping a chance of selection at all wage levels. It applied from the FY 2027 registration season.

What changed

  • USCIS selects H-1B cap registrations through a weighted process rather than a purely random one.
  • The weighting generally favours higher-skilled and higher-paid positions, while employers can still secure H-1B workers at all wage levels.

Who may be affected

  • F-1 graduates, including those on OPT, whose employers plan to register them in the H-1B cap.
  • Employers filing cap-subject H-1B petitions.

Key takeaways

  • The wage level of the job offer now affects the chance of selection.
  • The rule applied from the FY 2027 registration season onwards.

What students should do

  1. If you plan to work in the US after study, discuss the offered wage level with your employer before the registration period.
  2. Plan your OPT period knowing that H-1B selection is not guaranteed at any wage level.
